1. Agreement

These terms govern your use of ethanflynn.com and the tools made available through it, including the contact form, client portal, and electronic-signature pages (together, “the site”), operated by Ethan Flynn (“we”, “us”). By using the site you accept these terms. If you do not agree, please do not use the site.

2. What the site is

The site describes real-estate services offered by Ethan Flynn, a licensed real-estate agent with Benchmark Realty LLC in Tennessee, and lets you get in touch, request access to the Nashville Real Estate Data platform, review transaction documents, and sign documents electronically when you are a party to a transaction.

3. Not professional advice

Market data, charts, commentary, and other content on the site are provided for general information only. They are not an offer, a solicitation, or legal, tax, investment, or financial advice, and they do not create an agency or client relationship. An agency relationship with Ethan Flynn or Benchmark Realty LLC is formed only by a separately signed written agreement. Verify any information that matters to your decisions independently.

4. Acceptable use

You agree not to:

• use the site in a way that violates applicable law or the rights of others;
• attempt to gain unauthorized access to any part of the site, other users’ information, or the systems that host it;
• submit false, misleading, or automated (bot) form submissions; or
• scrape, resell, or redistribute content from the site without written permission.

5. Electronic records and signatures

When you use the site’s electronic-signature pages, you consent to transact business electronically, to receive transaction records electronically, and to the use of electronic signatures, consistent with the U.S. ESIGN Act and Tennessee’s Uniform Electronic Transactions Act. You may withdraw that consent for future documents by contacting us, in which case paper alternatives can be arranged.

6. Third-party services

The site links to and works with services we do not control, including the Nashville Real Estate Data platform, Calendly for scheduling, and Google for sign-in. Those services have their own terms and privacy policies, and we are not responsible for their content or practices.

7. Intellectual property

The site’s content — text, graphics, logos, and software — belongs to Ethan Flynn or its licensors and is protected by law. You may view and share links to the site for personal, non-commercial purposes; other uses require written permission.

8. Disclaimers and limitation of liability

The site is provided “as is” and “as available” without warranties of any kind, express or implied, including accuracy, availability, or fitness for a particular purpose. Market data can contain errors and can change without notice. To the fullest extent permitted by law, Ethan Flynn and Benchmark Realty LLC will not be liable for indirect, incidental, or consequential damages arising from your use of the site, and our total liability for any claim relating to the site will not exceed one hundred U.S. dollars. Nothing in these terms limits liability that cannot be limited under applicable law.

9. Governing law

These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Any dispute relating to the site will be brought in the state or federal courts located in Davidson County, Tennessee.

10. Changes

We may update these terms as the site evolves. Material changes will be reflected in a new effective date above. Continued use of the site after a change means you accept the updated terms.
